STOP - REQUIRED LEGAL AGREEMENT

You must complete this waiver before participating in any activities on this property.

This agreement includes a release of liability and assumption of risk involving firearms and outdoor activities.

ASSUMPTION OF RISK, RELEASE OF LIABILITY, AND INDEMNIFICATION AGREEMENT

PLEASE READ CAREFULLY. THIS IS A LEGALLY BINDING AGREEMENT.

I acknowledge that I am voluntarily participating in private, invite-only outdoor recreational activities on privately owned land, which may include, but are not limited to, shooting activities involving firearms, fishing, and general outdoor recreation (collectively, the “Activities”).

1. ASSUMPTION OF RISK

I understand that the Activities involve inherent and significant risks, including but not limited to:

  • Serious bodily injury or death from firearm discharge

  • Projectile impact, ricochet, or misfire

  • Negligent or accidental acts of other participants

  • Slips, trips, falls, uneven terrain, and environmental hazards

  • Hearing damage and exposure to loud noise\

I knowingly and voluntarily assume all risks, both known and unknown, associated with participation in the Activities.

2. FIREARMS ACKNOWLEDGMENT

I expressly acknowledge that:

  • Firearms are inherently dangerous

  • I am solely responsible for the safe handling, storage, and use of any firearm in my possession

  • I will only use firearms I am legally permitted to possess

  • I am responsible for ensuring my equipment is safe and in proper working condition

I understand that no firearms, ammunition, or equipment are provided, rented, or supplied by the Operator.

3. NO INSTRUCTION OR SUPERVISION

I understand and agree that:

  • The Operator is not providing instruction, training, or supervision

  • I am participating independently and at my own risk

  • I am solely responsible for my actions and decisions

4. COMPLIANCE WITH RULES

I agree to:

  • Follow all written and verbal safety rules and standard operating procedures

  • Immediately comply with all range commands and instructions from the designated Range Lead

  • Refrain from unsafe, reckless, or negligent behavior

I understand that failure to comply may result in immediate removal.

5. ZERO TOLERANCE POLICY

I certify that:

  • I am not under the influence of alcohol or drugs

  • I will not consume alcohol or drugs before or during participation in the Activities

6. RELEASE OF LIABILITY

To the fullest extent permitted by Minnesota law, I hereby release, waive, and discharge the Operator, property owners, and any affiliated individuals (collectively, the “Released Parties”) from any and all claims, demands, liabilities, or causes of action arising out of or related to my participation in the Activities, including those resulting from ordinary negligence.

7. LIMITATION OF RELEASE

I understand that this release does not apply to claims arising from gross negligence or willful or wanton misconduct.

8. INDEMNIFICATION

I agree to defend, indemnify, and hold harmless the Released Parties from any claims, damages, or expenses arising from:

  • My actions or omissions

  • My use of any equipment

  • Injury or damage caused by me to others

9. MEDICAL AUTHORIZATION

I authorize emergency medical treatment if necessary and accept full responsibility for any associated costs.

10. BINDING EFFECT

This Agreement shall be binding upon me, my heirs, estate, representatives, and assigns.

11. SEVERABILITY

If any provision of this Agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect.

12. GOVERNING LAW

This Agreement shall be governed by and interpreted in accordance with the laws of the State of Minnesota.

13. ACKNOWLEDGMENT OF UNDERSTANDING

I acknowledge that:

  • I have read and fully understand this Agreement

  • I understand that I am giving up certain legal rights

  • I am signing this Agreement voluntarily and without coercion

  • I understand firearms are present and involve risk of serious injury or death

  • I voluntarily assume all risks

  • I agree to follow all safety rules and SOPs

  • I confirm I am not under the influence of drugs or alcohol

  • I understand this is a release of liability and I am giving up legal rights
